The decision held that: In the invalidation procedure, both parties have the obligation to fulfill the necessary burden of proof for the facts they claim. Although there is a certain period of time between the first purchase of a product through Taobao and the resale of the product through the Xianyu platform, considering that the parties have submitted relatively complete transaction records, it can be proved that the product purchased from Taobao and the product resold by Xianyu are the same product. And considering the nature of the product itself, it is unlikely that the product has been replaced or modified, such as replacing its internal parts, without further evidence.

According to the law, if the patent owner is dissatisfied with the invalidation decision, he or she may file an administrative lawsuit with the Beijing Intellectual Property Court within three months.
