On January 14, 2022, the China National Intellectual Property Administration issued No. 53515 invalidation decision, declaring that all patent rights of “a lid (twist and turn sealed clamshell) owned by Lianghuadong were invalid.

After accepting the client's entrustment, Hengbo has done a lot of retrieval and found that there were prior arts in patent literature that were similar to the technology involved in this case. Based on this discovery, a request for invalidation to the accused patent was filed. After almost six months of trial, CNIPA finally decided that the all patent rights of “a lid (twist and turn sealed clamshell)” were invalid.

According to the law, if the patentee is dissatisfied with the invalidation decision, he or she can file an administrative lawsuit request with the Beijing Intellectual Property Court within three months.
