The China National Intellectual Property Administration Issued Invalidation Decision No. 581706 Declaring All Utility Model Patents For "A Bone Conduction Headset And Its Button Structure " Were Invalid

On September 4, 2024, the China National Intellectual Property Administration issued the Invalidation Decision No. 581706, declaring that all patent rights owned by Shenzhen Shokz Co., Ltd., entitled "A Bone Conduction Headset And Its Button Structure", were invalid.

 

 

 

After accepting the client's commission, the Hengbo team conducted a lot of arduous searches and ultimately successfully invalidated the patent.

 

The decision held that: if a claim has a distinguishing technical feature from the closest prior art, and the distinguishing technical feature is disclosed in other comparative documents or is common knowledge in the field, then the claim does not have substantial characteristics and progress, and does not have the inventiveness stipulated in Article 22, paragraph 3 of the Patent Law.

 

 

According to the law, if the patent owner is dissatisfied with the invalidation decision, he or she may file an administrative lawsuit with the Beijing Intellectual Property Court within three months.
