On April 18, 2024, the China National Intellectual Property Administration issued Invalidation Decision No. 568096, declaring that all patent rights owned by Hunan Huahui New Energy Co., Ltd., entitled "A Cylindrical Lithium Battery Negative Electrode Guide Pin Lead-out Structure", were invalid.

After accepting the client's commission, the Hengbo team conducted a lot of arduous searches and ultimately successfully invalidated the patent.

The decision holds that: there are distinguishing technical features between the technical solution claimed in the claim and the closest prior art. If the distinguishing technical features are disclosed in other prior art, and the role they play in the other prior art is the same as their role in the technical solution of the claim. On this basis, a person of ordinary skill in the art can obtain technical inspiration and thus obtain the technical solution of the claim, then the technical solution of the claim is obvious and therefore does not have an inventive step.

According to the law, if the patent owner is dissatisfied with the invalidation decision, he or she may file an administrative lawsuit with the Beijing Intellectual Property Court within three months.
