In order to implement the Outline for Building an Intellectual Property Powerhouse (2021-2035) and the 14th “Five-Year” Plan for Protection and Application of National Intellectual Property, to further implement the strategy of building an intellectual property powerhouse, and to accelerate the building of an intellectual property powerhouse, the key tasks and work measures during 2021 to 2021 are specified and this Promotion Plan is formulated.

 

I. Improve laws and regulations on intellectual property rights

1. Promote the revision of the Anti-Monopoly Law of the People's Republic of China, Rules for the Implementation of the Patent Law of the People's Republic of China, Several Provisions on Standardizing Patent Application Practices, and Provisions on the Protection of Trade Secrets, as well as the formulation of the Measures for the Administration of Trademark Agency. 20. We will formulate rules for protecting intellectual property rights in new fields and forms of industry such as big data, artificial intelligence, blockchain and gene technology. We will study and formulate compliance standards for open source intellectual property in information technology and code contribution rules and standards for open source communities, carry out studies on risks and compliance issues of open source intellectual property in the industry, and strengthen compliance assessment and training for open source intellectual property in the industry. 22. We will study and improve copyright protection measures for excellent stage art works of state-owned art troupes and private art performing troupes. I. Strengthen judicial protection

24. We will comprehensively review the achievements and problems of the trial work of the Supreme People's Court's intellectual property Court over the past three years, strengthen guidance to the intellectual property court and the intellectual property tribunal, and study and improve the intellectual property appeal mechanism. We will continue to push forward the reform of "three in one" IP trials, explore the establishment of a mechanism for coordinating the handling cases involving both civil and criminal punishments and civil litigation, and continue to push forward the pilot reform of separating complex and simple IP civil litigation procedures. We will strengthen anti-monopoly and anti-Unfair competition judication, formulate the Provisions of the Supreme People's Court on Several Issues concerning the Application of the Law in the Trial of Monopoly Civil Dispute Cases and the Interpretations on Several Issues concerning the Application of the Anti-Unfair Competition Law of the People's Republic of China, to safeguard the legal order of fair competition market. 27. Formulate the Opinions on Strengthening the Judicial Protection for Intellectual Property Rights of Traditional Chinese Medicine to promote the inheritance, innovation and development of traditional Chinese medicine. (Responsible by the Supreme People's Court)

Promote the system of notifying the litigious rights and obligations of rights holders in criminal cases of Intellectual property infringement and advancing trials for centralized and unified implementation of intellectual property procuratorial functions. Formulate judicial interpretations and standards for filing and prosecuting criminal cases of intellectual Property infringement and formulate the Guidelines for Examining Evidence in Public Prosecution of Criminal Cases of Intellectual Property Infringement. 31. We will step up patent, trademark and copyright law enforcement in key areas and regions and strengthen IP protection for online transactions. 32. Handle administrative adjudication requests for major patent infringement disputes and early settlement mechanism for drug patent disputes according to law. 35. We will formulate and implement the Guiding Opinions on Further Strengthening the Protection of Geographical Indications and deepened the reform of approving the use of geographical indications. 39. We will strengthen customs protection for intellectual property rights, step up efforts to crack down on IP infringement in key channels and links, carry out a campaign called "Dragon-Surge" to comprehensively strengthen IPR protection, a campaign named "Blue Net" to protect IPR in delivery channels, and a campaign "Net Net Action" to protect IPR in export and transshipment goods. We will strengthen customs protection for the exclusive rights of Olympic symbols. Issue an annual report on IP protection of China's customs and typical cases. Study and issue guidelines on protecting intellectual property rights in the seed industry and cracking down on infringement of sets of licenses, and severely crack down on infringements in the seed industry. Revise the Administrative Law Enforcement Measures on the Protection of New Varieties of Forest and Grass Plants and issue the annual report on the protection of China's forest and grass intellectual property rights and new varieties of forest and grass plants in 2021. 42. We will urge delivery enterprises to strictly implement their responsibilities and continue to crack down on illegal delivery of goods that infringe on intellectual property rights. (Responsible by State Post Bureau)

Promote the establishment of a research center for the protection of traditional Chinese medicine knowledge and carry out research on the establishment of a system for the protection of traditional Chinese medicine knowledge. I. Improve the quality of intellectual property creation

59. We will optimize the development indicators for intellectual property during the 14th Five-Year Plan period, strengthen quality orientation, formulate annual work guidelines for promoting high-quality development of intellectual property, strengthen statistical monitoring and feedback on intellectual property quality, and encourage local governments to completely cancel subsidies for patent and trademark applications. Promote the implementation of the Opinions on Promoting the Civil Application of Scientific and Technological Achievements in the National Defense Industry, and issue the Catalogue of Intellectual Property Rights Transformation in the National Defense Science, Technology and Industry (the seventh batch). Improve the mechanism for reviewing intellectual property rights in military exports and international cooperation. III. Promote market-oriented operation of intellectual property rights

78. Speed up the construction of key cities with IPR operation and service system, and establish a number of industrial IPR operation centers in key industries and industrial agglomeration areas. Formulate and improve policies on the market-based operation mechanism of intellectual property rights, improve operation and trading rules, strengthen supervision over operation platforms, and implement performance management throughout the whole process for key cities supported by financial funds. We will standardize and explore innovation in financing modes of intellectual property, encourage enterprises to take out insurance related to intellectual property, encourage financing guarantee institutions to develop guarantee products suitable for intellectual property, and explore new modes of risk sharing in financing of intellectual property pledge. We will share and exchange relevant guarantee information with the unified registration and publicity system for movable property financing of the Credit Investigation Center of the People's Bank of China in pilot cities with innovative business environments, and promote unified inquiry of registration information for movable property and guarantee of rights. Deepen the training of professional and technical personnel in the field of intellectual property rights, and do a good job in the evaluation of professional titles in intellectual property rights. 99. Increase support for the introduction and training of intellectual property professionals. In the assessment of leading groups and cadres under the central administration, attention should be paid to the effectiveness of the work related to intellectual property rights. We will strengthen external publicity, tell good stories about China's IPR, and conduct IPR training for developing countries. China will continue to push forward the negotiation process of the Treaty on the Protection of Broadcasting Organizations and the Treaty on the Protection of Traditional Cultural Expressions, promote the domestic implementation of the Marrakesh Treaty, and accelerate China's accession to the Hague Agreement on the International Registration of Industrial Designs. Promote the implementation of the chapter of Regional Comprehensive Economic Partnership (RCEP) about intellectual Property rights and the China-Eu Agreement on the Protection and Cooperation of Geographical Indications. China will continue to push forward negotiations on IPR issues in free trade agreements among China, Japan and South Korea, China and Norway, and China and Israel, and actively promote the process of joining the Comprehensive and Progressive Trans-Pacific Partnership (CPTPP). Strengthen the construction of the national overseas IP dispute response and guidance center, strengthen the overseas intellectual property information supply services, and strengthen the overseas intellectual property dispute response and guidance work of enterprises. 105. We will strengthen early warning and assistance for IPR protection for enterprises overseas, and explore the establishment of a foreign-related IPR risk prevention and control system. (Responsible by Propaganda Department of Central Committee, Ministry of Commerce, State Intellectual property Administration, and China Council for the Promotion of International Trade in accordance with the division of responsibilities)

 

106. Investigations will be carried out on the overseas IPR protection status of Chinese enterprises especially in countries and regions jointly building the Belt and Road, and a protection assessment mechanism will be established for relevant countries.  We will continue to promote IPR risk assessment projects in key countries and regions and issue regular reports, compile country guidelines for IPR protection in key countries and regions, and publish annual investigation reports and typical cases of IPR related lawsuits in key countries. 107. China will deepen practical cooperation on IPR with belt and Road countries and regions, provide diversified services such as patent search, review and training to belt and Road countries and regions, and advance cooperation in information and data resources. A high-level meeting on Belt and Road Intellectual Property rights will be held as appropriate. 108. China will deeply involve in multilateral IPR cooperation with BRIC nations, APEC, and other countries and organizations, strengthen interaction of policies and business rules, support industries to actively participate in related cooperation mechanisms, and host well the Meeting of directors of BRICS Intellectual Property Offices and the meeting of BRICS Intellectual Property Cooperation Mechanism. Strengthen bilateral IPR cooperation and consultation with the EU, Japan, Russia and other major trading partners. We will strengthen cooperation in IP review and improve the international cooperation network of "Patent Review Highway". 109. China will further promote multilateral and bilateral IP law enforcement cooperation and exchanges with law enforcement departments of other countries, International Criminal Police Organization, and World Customs Organizations. We will establish a cross-border customs cooperation mechanism and strengthen the exchange and sharing of information on IPR customs enforcement. Carry out overseas promotion and application projects of China's independent digital copyright protection and emergency broadcasting technical standards and carry out publicity and promotion of technical standards for "Belt and Road" countries. Formulate a plan for the division of key tasks in the Program for Building an Intellectual Property Powerhouse (2021-2035), study the establishment of a dynamic adjustment mechanism for the implementation of the strategy of building an intellectual property powerhouse, carry out annual monitoring, supervise and inspect to the implementation of work tasks, and incorporate it into relevant work evaluations.
