On April 2, 2020, the CNIPA issued No. 43960 Invalidation decision, declaring that all rights of the utility model patent, which was entitled "ventilator atomizer and ventilator of Komen Medical " of Shenzhen Koman Medical Equipment Co., LTD were invalid.

On October 25, 2019, the team of Hengbo accepted the entrustment of the client, doing a lot of retrieval on the prior art of the above-mentioned patent and founding that there are prior arts that are similar to the involved patent in patent literature. The Hengbo team filed a request for invalidation based on that and the CNIPA finally decided to invalidate all rights of the patent after nearly six months of trial.

According to the law, if the claimant disagrees with the invalidation decision, he or she can file an administrative litigation to the Beijing Intellectual Property Court within 3 months.
