This Outline is hereby formulated for the purposes of advancing the building of an intellectual property powerhouse in an overall manner, comprehensively improving intellectual property creation, use, protection, management and services, and maximizing the important role of the intellectual property system in the socialist modernization drive.

 

Since the 18th CPC National Congress, under the firm leadership of the CPC Central Committee with Xi Jinping at the core, China has made remarkable achievements in intellectual property development. The framework of intellectual property regulations and rules have been gradually improved; the number of high-value intellectual property such as core patents, well-known brands, top-quality copyrights, excellent new plant varieties, high-quality geographical indications, and high-level integrated circuit layout designs has increased dramatically; trade secret protection has been increasingly strengthened; the utilization of genetic resources, traditional knowledge and folk literature and arts has been steadily improved; the effects of protecting intellectual property, the benefits arising from their utilization, and their international influence have been significantly improved; and the intellectual property awareness of the public has been greatly enhanced. A group of market participants that are strongly competitive in intellectual property have emerged, and a path of intellectual property development with Chinese characteristics has been blazed, providing a strong support for turning China into an innovation-oriented country and a moderately prosperous society in all respects.

 

After China has entered a new stage of development, the promotion of high-quality development is an inevitable requirement for maintaining sustained and healthy economic development. As innovation is the primary driving force for development, the role of intellectual property as a strategic resource for national development and a core element of international competitiveness has become more prominent. The implementation of the strategy of turning China into an intellectual property powerhouse, responding to the challenges posted by new technologies, new economies, and new circumstances to the reform of the intellectual property system, the accelerated advancement of the intellectual property reform and development, properly coordinating the interaction relationship between governments and the market, between domestic markets and international markets, and between quantity and quality of intellectual property and the demand for and supply of intellectual property, the enhancement of China's comprehensive intellectual property strengths in all respects, and vigorously invigorating the innovation of the whole of society to build a world-class intellectual property powerhouse with Chinese characteristics are of great significance to enhancing the core competences of the country, pursuing high-standard opening up, achieving higher-quality development that is more efficient, equitable, sustainable, and secure, and meeting the ever-growing needs of people for a better life.

 

1. Guiding ideology.

Under the guidance of Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era, efforts shall be made to fully implement the guiding principles of the 19th CPC National Congress and the Second, Third, Fourth and Fifth Plenary Sessions of the 19th CPC Central Committee, advance the overall layout of the “Five-sphere Integrated Plan” coordinate and promote the strategic arrangement of the “Four-pronged Comprehensive Strategy” and remain committed to the underlying principle of making new progress while pursuing stable performance. With the promotion of high-quality development as the general aim, the furthering of supply-side structural reform as the central task, reform and innovation as the main engine, efforts shall be made to satisfy the fundamental goal of satisfying the people's growing desire for a better life, gain a foothold in the new development stage, put into practice the new development philosophy, and create a new development pattern. Our efforts shall also be made to profoundly understand that strengthening intellectual property protection is the most important part of improving the intellectual property protection system and also the biggest incentive to enhance China's economic competitiveness, effectively connect the whole chain of intellectual property creation, use, protection, management and services, step up international cooperation on intellectual property protection to build an intellectual property powerhouse featuring perfect systems, strict intellectual property protection, efficient operation, convenient services, cultural consciousness, opening-up, and a win-win situation, so as to provide strong support for turning China into an innovation-oriented country and a great modern socialist country.

 

2. Working principles

Providing legal guarantees to strictly protect intellectual property. Efforts shall be made to implement the basic strategy of comprehensive law-based governance, strictly protect intellectual property in accordance with the law, and practically safeguard social fairness and justice and the lawful rights and interests of rights holders.

 

Being driven by reforms and led by quality. Efforts shall be made to deepen reforms in the field of intellectual property, build a more perfect system and mechanism for the market-based allocation of production factors, and improve the functioning of the intellectual property system in providing basic guarantees to stimulate innovation, so as to provide a continuous driving force for high-quality development.

 

Making overall coordination with a focus on key fields. Efforts shall be made to remain committed to being guided by the strategies and making overall planning, highlight key fields and major needs, and promote the in-depth integration and development of intellectual property with economy, technologies, culture, and society.

 

Scientific governance and win-win cooperation. Efforts shall be made to remain committed to building a community with a shared future for mankind, plan and promote the intellectual property reform and development with a global vision, and advance the development of international intellectual property rules that are open, inclusive, balanced and universally beneficial, so that innovation and creation will bring more benefits to the people of all countries.

 

3. Development goals

By 2025, China will have made remarkable achievements in the building of an intellectual property powerhouse; intellectual property protection will have been more stringent; public satisfaction will have reached and remained at a relatively high level; the market value of intellectual property will have been further highlighted; brands will have become more competitive; the added value of patent-intensive industries and copyright industries will have respectively accounted for 13 percent and 7.5 percent of GDP; the total annual value of trade in intellectual property royalties will have reached 350 billion yuan; and the number of high-value invention patents per 10,000 people will have reached 12 (the aforesaid indicators are all expected ones).

 

By 2035, China will have ranked among the top countries of the world in terms of its comprehensive intellectual property competitiveness, with a complete intellectual property system; intellectual property will have enabled thriving innovation and entrepreneurship; the cultural awareness of the whole society for intellectual property will have basically taken shape; an international cooperation pattern featuring all-around and multilevel participation in global intellectual property governance will have been basically created; China will have been basically turned into a world-class intellectual property powerhouse with Chinese characteristics.

 

4. Establishing a complete, well-structured legal system featuring internal and external coordination. Basic legal research shall be conducted on intellectual property, and special laws and regulations shall be effectively connected, so as to enhance the applicability and unity of laws and regulations. The Patent Law, the Trademark Law, the Copyright Law, and the Regulation on the Protection of New Plant Varieties shall be amended in a timely manner based on actual circumstances, the formulation of special laws and regulations on geographical indications and designs shall be explored, a sound unified geographical indications protection system that is coordinated with special protection and trademark protection shall be established, and the regulations on integrated circuit layout designs shall be improved Laws and regulations on strengthening trade secret protection shall be formulated and amended, the legal system for regulating intellectual property abuse and legislation in such fields as anti-monopoly and anti-unfair competition related to intellectual property shall be improved. In addition, the Scientific and Technological Progress Law shall be amended. A legal system for special procedures that conforms to the laws of intellectual property trials shall be researched, established and improved, based on the amendments to applicable procedures laws and the implementation thereof. Intellectual property legislation shall be accelerated in new fields and business forms such as big data, artificial intelligence, and genetic technology. To meet the needs of scientific and technological progress and economic and social development, efforts shall be made to promptly promote the work to enact, amend, repeal, and interpret intellectual property laws and regulations according to the law, expand the scope of protection objects in due course, raise protection standards, and comprehensively establish and implement a system for paying punitive damages for infringements to increase damages.

 

5. Establishing a management system featuring unified functions and duties, sound standards, and excellent services. Management systems and mechanisms shall be continuously optimized, the power of the Central Government in the macro-management, regional coordination, and overall planning of foreign-related matters with regard to intellectual property protection shall be strengthened, and the development of appropriate institutions shall be enhanced to improve management efficiency. Centering on the regional coordinated development strategy of the state, regional intellectual property strategies shall be formulated and implemented, and the building of powerful intellectual property provinces and cities shall be furthered, so as to facilitate the coordinated regional intellectual property development. The construction project of first-class patent and trademark examination agencies shall be implemented, a patent and trademark examination officer system shall be established, and the collaborative mechanism for patent and trademark examination shall be optimized, so as to improve the quality and efficiency of examination. A regulatory system for intellectual property services featuring governmental supervision, public scrutiny, industry self-regulation, and institutional autonomy.

 

6. Establishing a fair, reasonable, and scientific policy framework. The policy orientation towards strictly protecting intellectual property shall be adhered to, the allocation mechanism of intellectual property rights and interests shall be improved, and the allocation system oriented to increasing the value of knowledge shall be perfected, so as to promote the realization of the value of intellectual property. The patent and trademark examination policies oriented towards strengthening protection shall be improved. The copyright registration system and the online protection and transaction rules for copyrights shall be perfected. The adjustment mechanism for intellectual property examination and registration policies shall be improved, and a dynamic examination management mechanism shall be established. A sound examination system for the legality and fair competition of intellectual property policies shall be established. An assessment mechanism for public policies regarding intellectual property shall be established.

 

7. Establishing a framework of intellectual property rules for both emerging fields and specific fields that can prompt responses and provide reasonable protection. Rules governing intellectual property protection of new technologies, new industries, new business formats, and new modes shall be improved. Ways shall be explored to improve the intellectual property protection system in the Internet field. Rules protecting the intellectual property of data shall be researched and developed. Open source intellectual property and its legal systems shall be improved. Rules protecting the intellectual property of algorithms, business methods, and artificial intelligence outputs shall be researched and improved The building of a system of access to genetic resources, traditional knowledge, and folk literature and arts and the fair and equitable sharing of benefits arising from their utilization shall be strengthened, as well as the collection, sorting, transformation, and utilization of intangible cultural heritage shall be strengthened. Effective connection between the protection of traditional knowledge of traditional Chinese medicine and the modern intellectual property system shall be advanced, the comprehensive protection system for intellectual property of traditional Chinese medicine shall be further improved, and a special examination and protection mechanism for patents of traditional Chinese medicine shall be established, so as to promote the inheritance and innovative development of traditional Chinese medicine.

 

8. Ensuring a sound judicial protection system with an impartial and efficient process, scientific jurisdiction, clear division of powers, and a complete set of rules. A project of establishment of high-level judicial authorities for the trial of intellectual property cases shall be implemented, the construction of trial foundation, systems and mechanisms, and intelligent courts shall be strengthened. Judicial authorities for the trial of intellectual property cases be improved, the distribution of judicial authorities shall be optimized, the trial mechanism for appeals shall be perfected, further steps shall be taken to advance the reform of the mechanism for the integrated trial of civil, criminal and administrative cases involving intellectual property, and a trial system for specialized case trials, centralized jurisdiction and streamlined procedures shall be built. Endeavors shall be made to provide more special training for intellectual property judges, select outstanding judges according to their professional performance, and strengthen the building of a team of technical investigators to improve the quality of case trials. The establishment of a cross-regional remote litigation platform for intellectual property cases shall be actively advanced. The judicial adjudication standards and the application of laws with regard to intellectual property cases shall be unified to improve adjudication rules. Intellectual property-related crimes shall be severely combated, and the criminal investigation system for intellectual property-related crimes shall be improved. The intellectual property-related judicial interpretations shall be amended and improved, and supporting standards for opening criminal cases involving intellectual property infringements for investigation and prosecution shall be formulated. The building of a procuratorial supervision mechanism for intellectual property cases shall be strengthened, and the guidance to sentencing recommendations and appeals shall also be strengthened.

 

9. Ensuring a sound administrative protection system that is convenient, efficient, strict, impartial, open, and transparent. The powers of investigation, punishment and enforcement of the appropriate administrative departments shall be allocated and exercised in scientific ways according to the law. Unified and coordinated law enforcement standards, evidence rules, and case guidance systems shall be established. The expertise of administrative enforcement officers and their levels of professionalism shall be vigorously improved, and the establishment of a technical investigator system for administrative protection of intellectual property shall be explored. An administrative law enforcement supervision platform for intellectual property cases shall be established to improve the modernization and intelligence of law enforcement supervision. An inspection, identification and evaluation system of infringement disputes over intellectual property shall be established and improved. The role of the administrative adjudication system of patent infringement disputes shall be maximized, and the enforcement of administrative adjudications shall be strengthened. A judicial confirmation system for administrative mediation agreements on resolving intellectual property disputes at the request of the parties concerned shall be explored. The cross-regional and inter-departmental collaboration mechanism for law enforcement protection shall be improved. An investigation mechanism for intellectual property protection in foreign trade and a special mechanism for intellectual property protection in pilot free trade zones shall be established. The customs protection of intellectual property shall be intensified, and international cooperation on intellectual property-related law enforcement shall be advanced.

 

10. Ensuring a sound coordinated protection pattern featuring unified leadership, smooth connection, and high efficiency. The centralized and unified leadership of the CPC Central Committee shall be adhered to, coordinated intellectual property protection shall be achieved through the fulfillment of duties by governments, strict regulation by enforcement agencies, impartial justice by judicial organs, well regulation of market participants, self-regulation and autonomy of industry organizations, and integrity and law compliance practice of the public. A project for the building of an intellectual property protection system shall be implemented. The functions and duties, powers, and jurisdiction of administrative agencies and judicial authorities shall be clarified, and the mechanism for coordination between administrative protection and judicial protection of intellectual property shall be improve to create joint protection forces. Arbitration, mediation, notarization, identification and evaluation, and rights protection and legal assistance systems with regard to intellectual property shall be established and improved, the building of the relevant systems shall be strengthened. The intellectual property credit regulation system shall be improved, the intellectual property credit regulation mechanism and the construction of relevant platforms shall be strengthened, and joint disciplinary actions shall be taken against serious dishonesty in the intellectual property field in accordance with laws and regulations. The collective management system for copyrights shall be improved, and the support for and regulation of collective management organizations of copyrights shall be strengthened. A geographical indication protection project shall be implemented. A network of intellectual property protection centers and a network of response and guidance centers for overseas intellectual property disputes shall be established. A sound platform for overseas early warning and rights protection and legal assistance information with regard to intellectual property shall be established.

 

 

 

11. Improving the market-oriented high-quality innovation mechanism with enterprises playing the leading role. The intellectual property assessment and evaluation mechanism shall be reformed and improved on the basis of quality and value. Market participants shall be guided in maximizing the combined effects of multiple types of intellectual property such as patents, trademarks, and copyrights, and a group of world-class enterprises that strongly competitive in intellectual property shall be fostered. Further steps shall be taken to implement the project for advancing the intellectual property strategy in small- and medium-sized enterprises. Intellectual property management in national science and technology programs shall be optimized. With the focus on cutting-edge technologies and key fields of biological breeding, a group of excellent new plant varieties with intellectual property shall be fostered at a faster pace, and the quality of licensed varieties shall be raised.

 

12. Ensuring a sound utilization mechanism that is functioning efficiently and smoothly and fully realize the value of intellectual property. The cultivation of patent-intensive industries shall be strengthened, and an investigation mechanism for patent-intensive industries shall be established. The positive role of patent navigation in regional development as well as government-backed major economic projects and scientific and technological projects shall be maximized, and the application of patent navigation in industries with traditional advances, strategic emerging industries, and development of industries of the future shall be vigorously promoted. The ownership and proceeds distribution mechanisms for state-owned intellectual property shall be reformed, to give scientific research institutes and higher education institutions greater autonomy in the disposal of intellectual property. A declaration system of intellectual property arising from government-backed scientific research projects shall established and improved. A statistics and release mechanism of intellectual property transaction prices shall be established. The building of trademarks and brands shall be advanced, the protection of well-known trademarks shall be strengthened, traditional brands and time-honored bands shall be properly developed and inherited, and well-known trademarks and brands with international influence shall be vigorously fostered. The role of the collective trademark or certification trademark system shall be maximized, and strongly competitive industrial cluster brands and region brands that have distinctive characteristics and good market shall be created. The effective integration of geographical indications with the development of characteristic industries, ecological progress, historical and cultural heritage, and revitalization of rural areas shall be advanced, and the brand influence and added value of geographical indications shall be increased. A project for the protection of geographical indications of agricultural products shall be implemented. Further steps shall be taken to launch the pilot and demonstration program for intellectual property, enterprises, higher education establishments, and scientific research institutions shall be impelled to improve their intellectual property management systems, and higher education establishments and scientific research institutions shall be encouraged to establish specialized agencies for the transfer and commercialization of intellectual property.

 

13. Establishing a market-oriented operation mechanism that are well-regulated, orderly, and dynamic. The agency, legal, information, consulting and other services with respect to intellectual property shall be enhanced, and the provision of value-added services such as asset appraisal, transactions, commercialization, custody, investment, and financing in relation to intellectual property shall be supported. Efforts shall be made to implement a project for the building of an intellectual property operation system, create integrated intellectual property operation service hub platforms, establish several platforms focusing on industries and driving regional development, foster market-oriented and specialized intellectual property service organizations with global perspectives, and conduct graded and classified assessment in the intellectual property service sector. The intangible asset appraisal system shall be improved, and a management mechanism featuring coordination between incentives and regulation shall be created. Intellectual property finance shall be developed actively and steadily, intellectual property pledge information platforms shall be improved, various intellectual property as mixed collaterals and intellectual property insurance products shall be encouraged, and the innovation on intellectual property financing modes shall be regulated and explored. Copyright trading and service platforms shall be improved, and the asset appraisal, registration and certification, pledged financing and other services with regard to works shall be strengthened. A national pilot program for copyright innovation and development shall be launched. An authorized trading system for national copyright exhibitions shall be established.

 

14. Enabling the supply of public services to complete full coverage and be more well-regulated, intelligent, and efficient. A project for development of intelligent intellectual property public services shall be implemented, the national intellectual property big data center and public service platform shall be improved, and the depth and breadth of opening of various basic intellectual property information shall be expanded to realize the sharing and integration with economic, technological, financial, legal, and other information. The "Internet plus" government services shall be further advanced, an intelligent examination and management system for patents and trademarks shall be established by full use of new technologies, and the examination process shall be optimized, so as to realize the integrated online government services and “one-stop” services with respect to intellectual property. The backbone service network shall be improved, service outlets such as technology and innovation support centers shall be expanded, and an interconnected, shared intellectual property public service system featuring governmental guidance and multi-party participation shall be built. Public consulting services with regard to intellectual property shall be made more specialized and convenient, and the intellectual property public service mechanism for small- and medium-sized enterprises and start-ups shall be improved. The intellectual property service mechanism for international exhibitions shall be improved

 

15. Strengthening the standardization, normalization, and reticulation of public services. Public service items related to intellectual property and the scope thereof shall be clarified, and a list of public service items and service standards shall be formulated. The tiered construction of public service organizations for intellectual property shall be advanced by category in an overall manner, and high-level specialized service organizations shall be vigorously developed. The efficiency of public services related to intellectual property shall be improved by effective use of information technology and comprehensive use of online and offline means. Communication channels shall be kept unimpeded to enhance public satisfaction with intellectual property public services.

 

16. Establishing an information service mode featuring the integration of data standards and resources, and efficient utilization of data. The formulation of intellectual property data standards and the supply of data resources shall be strengthened, and an information processing and service mechanism that are market-oriented and socialized shall be established. Efforts shall be made to regulate the intellectual property data trading market, promote the open sharing of intellectual property information, properly handle the relationship between the open sharing of data and data privacy and protection, enhance efficiency in the dissemination and utilization of such data, and fully realize the market value of intellectual property data resources. The coordinated development of public services and market-oriented services for intellectual property information shall be advanced. 17. Fostering cultural awareness for intellectual property that respects knowledge, advocates innovation, and encourages integrity, law compliance, and fair competition. Educational guidance, practice-based cultivation, and institutional guarantees shall be enhanced to cultivate citizens' behaviors and habits of consciously respecting and protecting intellectual property and enable citizens to consciously resist infringement and counterfeiting. An innovation-driven culture shall be encouraged, the concept of integrity and the spirit of contract shall be advocated, model enterprises that are determined to innovate and conduct business in good faith shall be vigorously publicized, and enterprises shall be guided in consciously fulfilling their social responsibilities to respect and protect intellectual property. A cultural atmosphere of fair competition shall be cultivated, cultural consciousness and self-confidence for intellectual property in the new era shall be fostered, and the integration, co-development and facilitation between intellectual property culture and the culture of rule of law, innovation-driven culture, and ethical conduct of citizens shall be advanced.

 

18. Establishing an intellectual property-related cultural communication matrix featuring novel content, diversified forms, and integrated development. An intellectual property-related cultural communication platform with the integrated development of traditional and emerging media shall be created to expand new media channels such as social media, short videos, and clients. Content, forms, and means shall be innovated, the foreign-related publicity of intellectual property shall be strengthened, and an all-media communication pattern covering domestic and international media shall be created, so as to build intellectual property publicity brands. High-end intellectual property think tanks and characteristic think tanks at the national level shall be vigorously developed, theoretical and policy research shall be deepened, and international academic exchanges shall be enhanced.

 

19. Creating a more open, active, and dynamic development environment for intellectual property professionals. The mechanism for training, evaluation and incentives, and mobile allocation of intellectual property professionals shall be perfected. Higher education institutions that have the power to independently examine the granting of academic degrees shall be supported in setting up a first-level intellectual property discipline. The establishment of degrees for the intellectual property discipline through demonstration shall be advanced. A special training plan for intellectual property professionals shall be implemented. A group of national intellectual property professional training bases shall be established depending on the appropriate higher learning institutions, and the construction of secondary intellectual property colleges in the appropriate higher learning institutions shall be strengthened. The building of a team of public lawyers in the administrative department for intellectual property, foreign-related intellectual property lawyers shall be effectively cultivated and trained, and the cultivation of intellectual property professionals with a global vision shall be strengthened. A group of excellent intellectual property courses shall be developed. Intellectual property education shall be provided for officials. Intellectual property education shall be advanced in primary and secondary schools, and the intellectual property awareness of young people shall be continuously enhanced.

 

20. Actively participating in the reform and building of the global governance system for intellectual property Opening-up shall be expanded in the intellectual property field, the international dialogue and exchange mechanism shall be perfected, and the improvement of international rules and standards for intellectual property and related international trade and investment shall be promoted. Multilateral and bilateral intellectual property negotiations in relation to the economy and trade with foreign parties shall be actively advanced. A foreign-related intellectual property risk prevention and control system shall be built. Cooperation with the intellectual property examination agencies of different countries shall be strengthened to promote the sharing of examination information. China shall be turned into a preferred location for international litigations involving intellectual property. The internationalization of arbitration relating to intellectual property shall be enhanced. High-level foreign institutions shall be encouraged to provide intellectual property services in China.

 

21. Building an international cooperation network featuring coordination and interaction of multilateral and bilateral mechanisms. Multilateral intellectual property cooperation systems shall be actively safeguarded and developed, and cooperation shall be strengthened in international frameworks and multilateral mechanisms such as the United Nations and the World Trade Organization. Pragmatic intellectual property cooperation with other countries and regions participating in the Belt and Road Initiative shall be deepened, high-level cooperation platforms shall be created, and cooperation in information and data resource projects shall be advanced, so as to provide patent search, examination, and training and other diversified services for countries and regions participating the Belt and Road Initiative. The external workforce with regard to intellectual property shall be strengthened. The role of non-governmental organizations in international intellectual property exchanges and cooperation shall be actively played. Overseas patent distribution channels shall be expanded. The effective combination of patents with the development of international standards shall be promoted. A good image of Chinese trademarks and brands shall be created, the mutual recognition and protection of geographical indications shall be advanced, and the promotion of Chinese trademarks and brands and geographical indication products to the world shall be strengthened.

 

22. Strengthening organization and leadership Efforts shall be made to comprehensively strengthen the leadership of the Party over the building of an intellectual property powerhouse, maximize the role of the State Council inter-ministerial joint meeting system for implementing the intellectual property strategy, establish a work system featuring unified leadership, interdepartmental coordination, and interaction between departments at higher and lower levels, and formulate an annual plan for advancing the implementation of this Outline. All local authorities and appropriate departments shall attach great importance thereto, strengthen organization and leadership, specify the division of tasks, establish and improve the work mechanism for coordinating the implementation of this Outline with the national economic and social development plans, key special plans, and applicable policies, make overall arrangements for the relevant tasks and measures based on their actual circumstances, and put them into practice on an item-by-item basis.

 

23. Providing better conditions and guarantees. The central and local fiscal investment guarantee systems shall be improved to increase support for the implementation of this Outline. By comprehensive use of fiscal, tax, investment, financing and other applicable policies, a diversified and multi-channel capital contribution system which focuses on priorities and is well-structured shall be created, to ensure the implementation of the tasks. Entities and individuals that have made outstanding contributions to the building of an intellectual property powerhouse shall be commended according to the applicable provisions issued by the state.

 

24. Strengthening assessment and evaluation. The China National Intellectual Property Administration shall, in conjunction with the appropriate departments, establish a dynamic adjustment mechanism for the implementation of this Outline, conduct annual monitoring and make summaries of regular assessment, supervise and inspect the implementation of tasks, with the supervision and inspection results included in the relevant work evaluation, and request instructions and report to the CPC Central Committee and the State Council about important information under procedures in a timely manner. With respect to the leaders of the Party and governments and the leadership teams of state-owned enterprises, attention shall be paid to the assessment of the results of their work relating to intellectual property. Local governments at all levels shall intensify supervision and assessment and include the building of an intellectual property powerhouse in the scope of supervision and assessment.
