This Outline is hereby formulated for the purposes of advancing the building of an intellectual property powerhouse in an overall manner, comprehensively improving intellectual property creation, use, protection, management and services, and maximizing the important role of the intellectual property system in the socialist modernization drive.

 

Strategic background

Since the 18th CPC National Congress, under the firm leadership of the CPC Central Committee with Xi Jinping at the core, China has made remarkable achievements in intellectual property development. The framework of intellectual property regulations and rules have been gradually improved; the number of high-value intellectual property such as core patents, well-known brands, top-quality copyrights, excellent new plant varieties, high-quality geographical indications, and high-level integrated circuit layout designs has increased dramatically; trade secret protection has been increasingly strengthened; the utilization of genetic resources, traditional knowledge and folk literature and arts has been steadily improved; the effects of protecting intellectual property, the benefits arising from their utilization, and their international influence have been significantly improved; and the intellectual property awareness of the public has been greatly enhanced. A group of market participants that are strongly competitive in intellectual property have emerged, and a path of intellectual property development with Chinese characteristics has been blazed, providing a strong support for turning China into an innovation-oriented country and a moderately prosperous society in all respects.

 

After China has entered a new stage of development, the promotion of high-quality development is an inevitable requirement for maintaining sustained and healthy economic development. As innovation is the primary driving force for development, the role of intellectual property as a strategic resource for national development and a core element of international competitiveness has become more prominent. The implementation of the strategy of turning China into an intellectual property powerhouse, responding to the challenges posted by new technologies, new economies, and new circumstances to the reform of the intellectual property system, the accelerated advancement of the intellectual property reform and development, properly coordinating the interaction relationship between governments and the market, between domestic markets and international markets, and between quantity and quality of intellectual property and the demand for and supply of intellectual property, the enhancement of China's comprehensive intellectual property strengths in all respects, and vigorously invigorating the innovation of the whole of society to build a world-class intellectual property powerhouse with Chinese characteristics are of great significance to enhancing the core competences of the country, pursuing high-standard opening up, achieving higher-quality development that is more efficient, equitable, sustainable, and secure, and meeting the ever-growing needs of people for a better life.

 

General requirements

  1. Guiding ideology.

Our efforts shall also be made to profoundly understand that strengthening intellectual property protection is the most important part of improving the intellectual property protection system and also the biggest incentive to enhance China's economic competitiveness, effectively connect the whole chain of intellectual property creation, use, protection, management and services, step up international cooperation on intellectual property protection to build an intellectual property powerhouse featuring perfect systems, strict intellectual property protection, efficient operation, convenient services, cultural consciousness, opening-up, and a win-win situation, so as to provide strong support for turning China into an innovation-oriented country and a great modern socialist country.

 

2. Working principles

Providing legal guarantees to strictly protect intellectual property. Efforts shall be made to implement the basic strategy of comprehensive law-based governance, strictly protect intellectual property in accordance with the law, and practically safeguard social fairness and justice and the lawful rights and interests of rights holders.

 

Being driven by reforms and led by quality. Efforts shall be made to deepen reforms in the field of intellectual property, build a more perfect system and mechanism for the market-based allocation of production factors, and improve the functioning of the intellectual property system in providing basic guarantees to stimulate innovation, so as to provide a continuous driving force for high-quality development.

3. Development goals

By 2025, China will have made remarkable achievements in the building of an intellectual property powerhouse; intellectual property protection will have been more stringent; public satisfaction will have reached and remained at a relatively high level; the market value of intellectual property will have been further highlighted; brands will have become more competitive; the added value of patent-intensive industries and copyright industries will have respectively accounted for 13 percent and 7.5 percent of GDP; the total annual value of trade in intellectual property royalties will have reached 350 billion yuan; and the number of high-value invention patents per 10,000 people will have reached 12 (the aforesaid indicators are all expected ones).

 

By 2035, China will have ranked among the top countries of the world in terms of its comprehensive intellectual property competitiveness, with a complete intellectual property system; intellectual property will have enabled thriving innovation and entrepreneurship; the cultural awareness of the whole society for intellectual property will have basically taken shape; an international cooperation pattern featuring all-around and multilevel participation in global intellectual property governance will have been basically created; China will have been basically turned into a world-class intellectual property powerhouse with Chinese characteristics.

 

Building an intellectual property system oriented to socialist modernization drive

4. Establishing a complete, well-structured legal system featuring internal and external coordination. Basic legal research shall be conducted on intellectual property, and special laws and regulations shall be effectively connected, so as to enhance the applicability and unity of laws and regulations. 5. Establishing a management system featuring unified functions and duties, sound standards, and excellent services. Management systems and mechanisms shall be continuously optimized, the power of the Central Government in the macro-management, regional coordination, and overall planning of foreign-related matters with regard to intellectual property protection shall be strengthened, and the development of appropriate institutions shall be enhanced to improve management efficiency. 8. Ensuring a sound judicial protection system with an impartial and efficient process, scientific jurisdiction, clear division of powers, and a complete set of rules. A project of establishment of high-level judicial authorities for the trial of intellectual property cases shall be implemented, the construction of trial foundation, systems and mechanisms, and intelligent courts shall be strengthened. The centralized and unified leadership of the CPC Central Committee shall be adhered to, coordinated intellectual property protection shall be achieved through the fulfillment of duties by governments, strict regulation by enforcement agencies, impartial justice by judicial organs, well regulation of market participants, self-regulation and autonomy of industry organizations, and integrity and law compliance practice of the public. A project for the building of an intellectual property protection system shall be implemented. The functions and duties, powers, and jurisdiction of administrative agencies and judicial authorities shall be clarified, and the mechanism for coordination between administrative protection and judicial protection of intellectual property shall be improve to create joint protection forces. Arbitration, mediation, notarization, identification and evaluation, and rights protection and legal assistance systems with regard to intellectual property shall be established and improved, the building of the relevant systems shall be strengthened. The intellectual property credit regulation system shall be improved, the intellectual property credit regulation mechanism and the construction of relevant platforms shall be strengthened, and joint disciplinary actions shall be taken against serious dishonesty in the intellectual property field in accordance with laws and regulations. The intellectual property assessment and evaluation mechanism shall be reformed and improved on the basis of quality and value. Market participants shall be guided in maximizing the combined effects of multiple types of intellectual property such as patents, trademarks, and copyrights, and a group of world-class enterprises that strongly competitive in intellectual property shall be fostered. Further steps shall be taken to implement the project for advancing the intellectual property strategy in small- and medium-sized enterprises. Intellectual property management in national science and technology programs shall be optimized. With the focus on cutting-edge technologies and key fields of biological breeding, a group of excellent new plant varieties with intellectual property shall be fostered at a faster pace, and the quality of licensed varieties shall be raised.

 

12. Ensuring a sound utilization mechanism that is functioning efficiently and smoothly and fully realize the value of intellectual property. The cultivation of patent-intensive industries shall be strengthened, and an investigation mechanism for patent-intensive industries shall be established. The positive role of patent navigation in regional development as well as government-backed major economic projects and scientific and technological projects shall be maximized, and the application of patent navigation in industries with traditional advances, strategic emerging industries, and development of industries of the future shall be vigorously promoted. The ownership and proceeds distribution mechanisms for state-owned intellectual property shall be reformed, to give scientific research institutes and higher education institutions greater autonomy in the disposal of intellectual property. Copyright trading and service platforms shall be improved, and the asset appraisal, registration and certification, pledged financing and other services with regard to works shall be strengthened. A national pilot program for copyright innovation and development shall be launched. An authorized trading system for national copyright exhibitions shall be established.

 

Building an intellectual property public service system for the public convenience and in the public interest

21. Building an international cooperation network featuring coordination and interaction of multilateral and bilateral mechanisms. Multilateral intellectual property cooperation systems shall be actively safeguarded and developed, and cooperation shall be strengthened in international frameworks and multilateral mechanisms such as the United Nations and the World Trade Organization. Pragmatic intellectual property cooperation with other countries and regions participating in the Belt and Road Initiative shall be deepened, high-level cooperation platforms shall be created, and cooperation in information and data resource projects shall be advanced, so as to provide patent search, examination, and training and other diversified services for countries and regions participating the Belt and Road Initiative. The external workforce with regard to intellectual property shall be strengthened. The role of non-governmental organizations in international intellectual property exchanges and cooperation shall be actively played. Overseas patent distribution channels shall be expanded. The effective combination of patents with the development of international standards shall be promoted. A good image of Chinese trademarks and brands shall be created, the mutual recognition and protection of geographical indications shall be advanced, and the promotion of Chinese trademarks and brands and geographical indication products to the world shall be strengthened.

 

Organizational Support

22. Strengthening organization and leadership Efforts shall be made to comprehensively strengthen the leadership of the Party over the building of an intellectual property powerhouse, maximize the role of the State Council inter-ministerial joint meeting system for implementing the intellectual property strategy, establish a work system featuring unified leadership, interdepartmental coordination, and interaction between departments at higher and lower levels, and formulate an annual plan for advancing the implementation of this Outline. By comprehensive use of fiscal, tax, investment, financing and other applicable policies, a diversified and multi-channel capital contribution system which focuses on priorities and is well-structured shall be created, to ensure the implementation of the tasks. Entities and individuals that have made outstanding contributions to the building of an intellectual property powerhouse shall be commended according to the applicable provisions issued by the state.

 

24. Strengthening assessment and evaluation. The China National Intellectual Property Administration shall, in conjunction with the appropriate departments, establish a dynamic adjustment mechanism for the implementation of this Outline, conduct annual monitoring and make summaries of regular assessment, supervise and inspect the implementation of tasks, with the supervision and inspection results included in the relevant work evaluation, and request instructions and report to the CPC Central Committee and the State Council about important information under procedures in a timely manner. With respect to the leaders of the Party and governments and the leadership teams of state-owned enterprises, attention shall be paid to the assessment of the results of their work relating to intellectual property. Local governments at all levels shall intensify supervision and assessment and include the building of an intellectual property powerhouse in the scope of supervision and assessment.
