On January 3, 2018, the China National Intellectual Property Administration (hereinafter refered as CNIPA) issued an invalidation decision No. 34371, declaring that the patent rights of utility model, entitled "power battery and electric vehicle", which were owned by Beijing Electric Vehicle Co.,Ltd. were partially invalid.

On June 19, 2017, the Hengbo team accepted the client's commission,obtaining evidence evaluating the patent's creativity through a large number of searches, and finally filed a request for invalidation of the above patent. After six months of trial, CNIPA finally made a decision to declare the patent partially invalid. As a result, the patentee had to combine 6 dependent claims into one independent claim 1. So far, the protection scope of the patent has been greatly reduced and so has been the risk of infringement for client. 

According to the law, the patentee, who is dissatisfied with the invalidation decision, can file an administrative lawsuit request with the Beijing Intellectual Property Court within three months.
